Why the Vote with weVote has Legal Validity

weVote‘s electronic and/or online voting is fully legally valid, because it compliance on to 100% with the requirements and/or principles set out in the “Recommendation CM/Rec(2017) of the Committee of Ministers to member States on standards for e-voting”. In other words, it respects the requirements that the EU has established in the framework of the called E-Poll Project (Electronic Poll system for remote voting), whose objective is to “stimulate the participation of European citizens in the elections making available a facilitated voting system, thanks to which voters are no longer obliged to go to a specific place to exercise one’s own right, but they can do so from any e-voting station.”.

As a consequence, we now turn to the reasons why the eVote system, developed by weVote, respect every principle set out in the above-mentioned Recommendation:

I. Universal Suffrage:

We affirm that weVote’s electronic voting system complies with the principle under analysis because:

  • The voting interface used by the voter is understandable and easy to use,
  • The eventual registration to the electronic voting system does not represent a voter disincentive for participation in e-voting,
  • It is designed to maximize voting opportunities for persons with disabilities.

II. Equalitarian Sufrage:

Also, we underline, once again, the full legal validity of the weVote e-voting system because it ensures that every voter and/or elector, in any electoral process, do not insert more than one ballot paper in the electronic ballot box. In other words, each voter can cast his or her vote only once.

Secondly, each vote deposited in the electronic ballot box and each vote cast is counted only once.

Finally, in the case where there is the use, within the same electoral process, of electronic and non-electronic voting channels, we have a secure and reliable method for aggregating all votes and for calculating and certifying the correct final result.

III. Free suffrage:

Our voting system guarantees the principle of free suffrage because:

  • It provides for the free formation and expression of the voter’s opinion,
  • Our voting platform is structured to the extent that the voters are guided in the voting process in such a way that they are prevented from hastily casting their vote, in other words, we offer to the voter the opportunity to vote in a reflective manner,
  • Our voting system does not exert any manipulative influence on the voter during the entire electoral process,
  • We allow the expression of the so-called blank vote,
  • We clearly indicate to the voter when the vote has been successfully cast,
  • If the voter, before the end of the voting process, votes in the wrong way, he or she has the possibility to go back on the voting page to properly express his or her own will. And, then, he or she can finish the voting process in line with his or her correct decision/s,
  • We prevent the modification of the vote after it has been expressed.

IV. Secret Suffrage:

weVote respect this principle because:

First of all, we guarantee the secret ballot insofar as we exclude, at any stage of the voting process, anything that could jeopardise the secrecy of the ballot.

Secondly, we ensure that the votes in the electronic ballot box and the votes that are being counted be and remain anonymous. And, also, we ensure that it is not possible to rebuild the link between the vote and the voter. In other words, it is not allowed to link the result to each voter.

Finally, we take measures to ensure that the necessary information, during electronic processing, may not be used to violate the secrecy of the ballot.

Finally, we underline further characteristics which guarantee the legal and evidentiary validity, at European level, of the vote express through the service offered by weVote:

  • We take all possible and useful measures to avoid the possibility of fraud or unauthorized interventions that could attack the voting system during the voting process,
  • We have measures in place to preserve the availability of services during the voting process. In other words, our system is resistant to malfunctions, failures or service attacks,
  • We provide for so-called voter accreditation before and during the election and/or voting process,
  • The voting system is auditable,
  • We certify the entire voting process in line with the certification process that allow any ICT (Information and Communication Technology) component to be tested and certified in accordance with the technical requirements of the EU.
